NYLC.org Usage Agreement

By using the National Youth Leadership Council (NYLC) website (nylc.org) or any of NYLC affiliated extranets, or submitting content for either, you agree to abide by the following Usage Agreement. Unless otherwise specified, requirements apply to both NYLC.org as well as NYLC extranets.

Submitting Project Examples

NYLC encourages users to submit project examples that would benefit other users. Though NYLC requires only basic information about the project, submitters are encouraged to provide as many details as possible in order to provide users with the maximum amount of information.

NYLC posts only submissions it deems both excellent examples of service-learning and also useful additions to its database. Please understand that good project examples may be rejected for a number of reasons, including simply being too similar to existing examples. If your project is used, you may be contacted by NYLC for additional information and possibly supporting materials to be used as downloads.

All project examples will be edited by NYLC to fit its editorial style. All dates and identifying details — including the names of schools, organizations, and individuals — will be removed in order to provide examples that are generic enough for use by other groups. Submitters will be credited if requested, but names of minors will not be posted.

By submitting a project example, you agree that NYLC will have a perpetual, non-exclusive worldwide right to use, as it sees fit, the project example and all related downloadable materials, and users of nylc.org will have the rights to use those materials in ways consistent with this Usage Agreement.

Posting Information

In certain sections of nylc.org and affiliated extranet users may freely post comments and suggestions in response to project examples and other selected content, and recommend resources and provide advice to other users. These features are provided to encourage the sharing of experiences and knowledge that will lead to stronger service and learning. Posting

  • Must be relevant to the content with which it is associated.
  • Must provide constructive information to improve the implementation of similar projects or the usefulness of the associated content.
  • May not include personal insults, obscenities, or unrelated content.

Though postings are not moderated, NYLC reserves the right to delete or edit postings as it sees fit. NYLC will have a perpetual, non-exclusive worldwide right to use and authorize use of, as it sees fit, all information posted on NYLC website or affiliated extranet.

Copyrights

Copyrights for materials posted on nylc.org reside with NYLC or, when credited, other contributors. For permission to use any of this material in ways not described above, please contact NYLC.

Using Posted Materials

NYLC provides materials to help educators, community-based organizations, and young people create and implement successful, high-quality service and learning.

Website users are granted permission to download, print out, and use documents from nylc.org or affiliated extranet for their own personal and professional purposes so long as they do not make any charge for copies of such documents provided to or used by third parties; do not include such documents on another website; do not make or distribute more than 25 copies of any such document; do not include such documents in any other publication whether in print, electronic, or other form; and do not otherwise republish any such document.

Printouts and other copies of any documents from nylc.org, including web pages, must be made and used in their entirety and not altered in any way. Materials may not be reposted, reprinted, redistributed, or used as part of any profit-making venture, except as described above, without express written permission from NYLC.

The purpose of the foregoing permission is to allow NYLC website users to download, print out, and use such documents for their own strictly personal and professional purposes, to pass copies of such documents along to colleagues for the same type of use, to use such documents in training that they conduct themselves, and similar uses — all without making any charge related to such documents. Eligibility (NYLC Extranets Only)

NYLC Extranets are intended solely for specific users who have been approved by an NYLC site administrator or staff member. Any registration by, use of or access to any NYLC extranet by anyone not authorized for use by NYLC staff is unauthorized and in violation of this Usage Agreement. By using an NYLC extranet, you represent and warrant that you have complied with all terms and conditions of this agreement, have been approved for site use by an NYLC staff member.

Termination (NYLC Extranets Only)

NYLC may terminate your membership, delete your profile and any content or information that you have posted on the Site and/or prohibit you from using or accessing the Service or the Site (or any portion, aspect or feature of the Service or the Site) for any reason, or no reason, at any time in its sole discretion, with or without notice, including if it believes that your account was not approved by NYLC staff. Registration Data/Account Security In consideration of your use of the Site, you agree to (a) provide accurate, current, and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to NYLC, to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account.

Code of Conduct

In addition, you agree not to use the Service or the Site to:

  • harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
  • use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site;
  • use automated scripts to collect information from or otherwise interact with the Service or the Site;
  • upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
  • upload, post, transmit, share, store or otherwise make available any videos other than those of a personal nature that: (i) are of you or your friends, (ii) are taken by you or your friends, or (iii) are original art or animation created by you or your friends;
  • register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
  • impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
  • upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
  • upload, post, transmit, share, store or otherwise make publicly available on the Site any private information of any third party, including, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;
  • solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
  • upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • intimidate or harass another;
  • upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
  • use or attempt to use another's account, service or system without authorization from NYLC, or create a false identity on the Service or the Site.
  • upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of NYLC, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose NYLC or its users to any harm or liability of any type.

You are solely responsible for your interactions with other NYLC extranet users. We reserve the right, but have no obligation, to monitor disputes between you and other users.

Third Party Websites and Content

The Site contains (or you may be sent through the Site or the Service) links to other web sites ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third parties (the "Third Party Applications, Software or Content"). Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed through the Site or any Third Party Applications, Software or Content posted on, available through or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Applications, Software or Content. Inclusion of, linking to or permitting the use or installation of any Third Party Site or any Third Party Applications, Software or Content does not imply approval or endorsement thereof by us. If you decide to leave the Site and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the Site or relating to any applications you use or install from the site.

Disclaimers

The Site and the Service may be temporarily unavailable from time to time for maintenance or other reasons. NYLC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. NYLC is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to User's or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Web and/or in connection with the Service.

Children Under Age 13

NYLC does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for NYLC website or extranet services or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on NYLC websites or extranets. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental or school consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at nylcinfo@nylc.org.

Children between the Ages of 13 and 18

NYLC requests that minors over the age of 13 have received permission from their school or educational institution before sending any information about themselves to anyone over the Internet. NYLC holds each minor's school responsible for obtaining parental permissions to use NYLC websites or extranets. If you believe that a minor over the age of 13 is using an NYLC website or extranet without their school or educational institution's approval, please contact us at nylcinfo@nylc.org.

Governing Law; Venue and Jurisdiction

By visiting or using the Site and/or the Service, you agree that the laws of the State of Minnesota, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and NYLC or any of our affiliates. With respect to any disputes or claims not subject to arbitration (as set forth below), you agree not to commence or prosecute any action in connection therewith other than in the state and federal courts of California, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of California.

Unless otherwise specified, the terms "includes", "including", "e.g.,", "for example", and other similar terms are deemed to include the term "without limitation" immediately thereafter. Terms used in these Terms with the initial letter(s) capitalized will have the meaning attributed to them in these Terms.
